$50 Filing Fee on Mortgage Foreclosure Actions Reinstated

On May 10, Governor Mike Pence signed into law House Enrolled Act 1084, which assesses a $50.00 filing fee on all mortgage foreclosure cases filed with Indiana trial courts. This fee was previously collected in all foreclosure actions filed between July 1, 2009 and December 31, 2012.
Since January 2010, a portion of this fee has been used to fund the Mortgage Foreclosure Trial Court Assistance Project (MFTCAP). The MFTCAP provides attorney facilitators to trial courts to assist borrowers and lenders in coming to a mutually-agreeable resolution (when available) in lieu of foreclosure. To date, this program has allowed more than 5,500 Indiana families to remain in their homes.
This fee is effective from May 10, 2013, to January 1, 2015.
